It examines the legal consequences arising from these proceedings and the procedural defects that may affect the rights of co-owners. The study is supported by case law from the Constitutional Court and the Supreme Court of Justice, emphasizing the importance of judicial rulings regarding procedural errors that may negatively impact the rights of co-owners. Additionally, it explains that in partition proceedings the sworn valuation statement is not always required, particularly when improvements are claimed, in which case an expert appraisal is sufficient. Finally, it analyzes the right of co-owners to acquire portions of the co-owned property, including, in the case of real estate, larger extensions even if they are not originally part of the co-ownership.El trabajo de investigación analiza los procesos divisorios en el marco del Código Civil y el Código General del Proceso, abordando sus antecedentes, definición, objetivos, procedimientos y el alcance de la compra que pueden realizar los copropietarios bajo distintas circunstancias. Se estudian las consecuencias jurídicas derivadas de estos procesos y los posibles defectos procesales que pueden afectar los derechos de los comuneros. El análisis se apoya en jurisprudencia de la Corte Constitucional y la Corte Suprema de Justicia, destacando la importancia de sus pronunciamientos frente a errores procesales que puedan incidir negativamente en los derechos de los copropietarios. Asimismo, se explica que en los procesos divisorios no siempre es obligatorio el juramento estimatorio, especialmente cuando existen mejoras, caso en el cual basta con un dictamen pericial.
