The action of Asset Forfeiture has the potential to apply to any type of property with economic value. However, given the particularities of the shares that represent a company’s capital, it is worthwhile to analyze the guidelines established by the legal system when the Asset Forfeiture action targets this type of intangible property. Naturally, the analysis also requires consulting and critically examining judicial and doctrinal rulings, in order to identify both the legal tensions and the solutions that the sources of law have provided regarding the subject of this study.La acción de Extinción de Dominio consagrada en el artículo 34 de la Constitución Política como un instrumento de castigo del enriquecimiento ilícito y tutela del Tesoro Público y la Moral Social, ha presentado un desarrollo normativo que ha dado lugar a la codificación de la regulación a través de la expedición de la Ley 1708 de 2014 (Código de Extinción de Dominio). La acción de Extinción de Dominio tiene la potencialidad de recaer sobre cualquier tipo de bienes susceptibles de valoración económica. No obstante, teniendo en cuenta las particularidades de los títulos que representan el capital de una sociedad, vale la pena analizar las directrices que el ordenamiento jurídico ha determinado cuando la acción de Extinción De Dominio tiene por objeto este tipo de bienes intangibles.
