Therefore, it is essential to identify elements that, with a certain degree of certainty, make it possible to establish the State’s responsibility in situations that are not contractually covered but that may nevertheless cause harm through its action or inaction. At this point, it becomes necessary to specifically address the **pre-contractual liability of the State**, with the aim of enabling a real and concrete strengthening of one of the fundamental pillars of any **Rule of Law: legal certainty**. This objective is the main driving force behind the ideas presented here.El accionar del Estado por estar en evidente situación de ventaja frente a los particulares debe estar investido de las máximas garantías y lineamientos que aseguren total respeto a los derechos de estos. Por lo tanto, se hace de vital importancia buscar elementos que con algún grado de certeza permitan establecer la responsabilidad del Estado en situaciones no cobijadas contractualmente, pero que en todo caso revisten la posibilidad de generar un daño por su acción o inacción. En este punto es que se considera necesario abordar en particular, la responsabilidad precontractual por parte del Estado, en aras de posibilitar un fortalecimiento real y concreto de uno de los pilares de todo Estado de Derecho: la seguridad jurídica.
