It concludes that it does not, primarily due to structural overcrowding, deficient criminal policy, excessive use of pretrial detention, the mixing of those awaiting trial and convicted prisoners, lack of infrastructure, and the limited application of prison benefits. The study reviews international treaties (UN and OAS), Colombian legislation, and statistics from the National Penitentiary and Prison Institute (INPEC) between 2000 and 2018. It argues that the Colombian state maintains an unconstitutional state of affairs, where rights such as human dignity, health, due process, separation of inmates, and rehabilitation are violated.El documento analiza si el sistema penitenciario colombiano cumple con los estándares internacionales de derechos humanos.
