The central legal problem lies in the tension between the robust catalog of rights established in the 1991 Constitution—based on human dignity, equality, and the free development of personality—and the absence of a specific legal prohibition that penalizes these practices within the domestic legal system. Through a qualitative approach and a documentary research design, this study examines the national regulatory framework, the standards set by the Inter-American Human Rights System, and the jurisprudence of the Colombian Constitutional Court. The study identifies that, although general ethical principles and provisions on health and non-discrimination exist, the lack of a specific punitive pathway creates a normative void that encourages the invisibilization of victims and limits the material effectiveness of state protection. Finally, the monograph concludes that it is imperative to strengthen the legal framework by creating institutional mechanisms that transcend constitutional rhetoric, thereby guaranteeing the psychophysical integrity and autonomy of individuals with diverse sexual orientations and gender identities against interventions that lack scientific basis and violate the very essence of the Social State of Law.La presente investigación analiza el alcance de la protección constitucional de los derechos fundamentales de la población LGBTIQ+ en Colombia, frente a la persistencia de los denominados Esfuerzos para Cambiar la Orientación Sexual y la Identidad de Género (ECOSIEG), comúnmente conocidos como "terapias de conversión". El problema jurídico central radica en la tensión existente entre el robusto catálogo de derechos consagrado en la Constitución de 1991 —sustentado en la dignidad humana, la igualdad y el libre desarrollo de la personalidad— y la ausencia de una prohibición legal taxativa que sancione estas prácticas en el ordenamiento jurídico interno. A través de un enfoque cualitativo y un diseño de investigación documental, se examina el marco normativo nacional, los estándares fijados por el Sistema Interamericano de Derechos Humanos y la jurisprudencia de la Corte Constitucional colombiana. El estudio identifica que, si bien existen principios éticos y disposiciones generales sobre salud y no discriminación, la carencia de una ruta sancionatoria específica genera un vacío normativo que favorece la invisibilización de las víctimas y limita la eficacia material de la protección estatal.
