These restrictions on fundamental rights, such as the right to work and the right to be elected, are justified by the need to ensure principles such as morality, impartiality, efficiency, transparency, and public trust in the exercise of public office. This study argues that the application of this regime to candidates and their relatives may generate violations of political and labor rights, particularly affecting family members of public officials. The research focuses on the legal provisions, case law, and doctrine related to the issue, especially analyzing Article 33 (paragraph 5) of Law 617 of 2000. The central research question examines whether the application of incompatibility and disqualification rules for members of departmental public corporations, based on links with other territorial entities, violates the political and labor rights of their relatives. The methodology is structured in three stages: first, the definition of the legal framework for elected public officials in Colombia; second, the identification and classification of disqualifications and incompatibilities applicable to such positions; and third, an analysis of potential constitutional rights violations arising from these rules, with particular attention to inequalities created by the application of the legal provisions. The study concludes by highlighting concerns regarding possible excesses and inequities in the current legal regime governing disqualifications and incompatibilities in Colombia.El régimen de inhabilidades e incompatibilidades corresponde a normas constitucionales y legales que establecen circunstancias que impiden a una persona ser elegida o ejercer un cargo público. Estas restricciones a derechos fundamentales como el trabajo y el derecho a elegir y ser elegido se justifican en la necesidad de garantizar principios como la moralidad, imparcialidad, eficiencia, transparencia y confianza en la función pública. El estudio plantea que la aplicación de este régimen puede generar posibles vulneraciones a derechos políticos y laborales, especialmente en relación con los familiares de los servidores públicos. El análisis se centra en la normativa, la jurisprudencia y la doctrina, con énfasis en el numeral 5 del artículo 33 de la Ley 617 de 2000. La pregunta central de investigación examina si la aplicación de inhabilidades e incompatibilidades a miembros de corporaciones públicas departamentales, por vínculos con otros entes territoriales, vulnera los derechos de sus familiares.
