It seeks to determine the gaps in Colombian regulations regarding these workers, since they must have sufficient guarantees to be able to carry out their daily work while enjoying their fundamental rights. Therefore, this research was conducted under a qualitative study model, being an empirical, non-systematic investigation that problematizes a social reality surrounding access to health services for a marginalized population, such as women who engage in sex work, affecting their dignity and other rights. It seeks to determine the gaps in Colombian regulations regarding these workers, since they must have sufficient guarantees to be able to carry out their daily work while enjoying their fundamental rights. The observation window on the regulations and jurisprudential background for sex workers within the framework of health protection is developed within a timeframe from 2006 to the present, as these are the periods in which the greatest number of workers in Bogotá can be seen. Likewise, from these dates, the process and development of this phenomenon will be delimited and, consequently, the guarantees that the Law has provided them over the years will be evident. From this observation window, it is possible to verify the existence of a limited framework or whether, on the contrary, they have sufficient guarantees to carry out their daily work. In light of the above, it is relevant to investigate the regulations regarding health and evaluate their application based on a study of the problems faced by sex workers in Bogotá. The value of this research lies in the importance of health for this group, and with the analysis carried out and previous research, we can make their health reality more visible and better understand it.La presente monografía problematiza una realidad social en torno del acceso a los servicios de salud de una población marginada, como lo es la población de mujeres que ejercen el trabajo sexual; afectando su dignidad y otros derechos. Busca determinar los vacíos existentes en la normatividad colombiana frente a las trabajadoras en mención, puesto que deben contar con las suficientes garantías, para poder desempeñar sus labores diarias gozando de sus derechos fundamentales. siendo así, la presente investigación se realizó bajo un modelo de estudio de tipo cualitativo, siendo una investigación empírica, no sistemática, que problematiza una realidad social en torno del acceso a los servicios de salud de una población marginada, como lo es la población de mujeres que ejercen el trabajo sexual; afectando su dignidad y otros derechos. Busca determinar los vacíos existentes en la normatividad colombiana frente a las trabajadoras en mención, puesto que deben contar con las suficientes garantías, para poder desempeñar sus labores diarias gozando de sus derechos fundamentales. La ventana de observación sobre la normatividad y los antecedentes jurisprudenciales para las trabajadoras sexuales en el marco de protección de la salud se desarrollan en un marco temporal desde el año 2006 hasta la actualidad, ya que son los periodos en donde se puede evidenciar el mayor número de trabajadoras en Bogotá. Así mismo, a partir de estas fechas se delimitará el proceso y desarrollo de dicho fenómeno y, por consiguiente, se evidenciará cuáles son las garantías que en el transcurso de estos años les ha brindado la Ley. A partir de esa ventana de observación se puede constatar la existencia de un reducido marco o si, por el contrario, cuentan con garantías suficientes para desempeñar sus labores diarias. En virtud de lo anterior, resulta relevante investigar la normatividad referente a la salud y evaluar la aplicación de la normatividad partiendo del estudio de la problemática de las trabajadoras sexuales en Bogotá.
