It examines how these guarantees—the right to challenge evidence, the right to a public hearing, the right to a defense, the right to impartiality, the right to a natural judge, and the presumption of innocence—seek to balance the State's punitive power and protect citizens from potential abuses. The study describes the historical evolution of due process, its constitutional and international foundations, and how it is implemented in the stages of the process: investigation, formal charges, indictment, trial, and sentencing. It concludes that, although the accusatory model aims for greater transparency and participation, structural flaws persist in practice, particularly regarding legal representation, equality of arms, and effective access to justice.El trabajo analiza las garantías procesales como fundamento del debido proceso dentro del Sistema Penal Acusatorio colombiano (Ley 906 de 2004). Examina cómo estas garantías —contradicción, publicidad, defensa, imparcialidad, legalidad, juez natural y presunción de inocencia— buscan equilibrar el poder punitivo del Estado y proteger al ciudadano frente a posibles abusos. El estudio describe la evolución histórica del debido proceso, sus bases constitucionales e internacionales, y cómo se materializa en las etapas del proceso: investigación, formulación de imputación, acusación, juicio y sentencia.
