Using a qualitative and documentary approach, the corresponding legal framework, the dominant historical circumstances, modifications to the domestic legal system and structural barriers that restrict the effective implementation of IHL. The study makes it possible to analyze the restrictions for the application of laws in situations of state vulnerability. The DRC is thus a particular case that poses significant challenges to the skill of international law.Esta monografía examina la función del Derecho Internacional Humanitario en el conflicto bélico no internacional que impacta a la RDC, en el que los contextos de violencia tienen una duración de más de dos décadas. Utilizando un enfoque cualitativo y documental, se ha analizado el marco legal correspondiente, las circunstancias históricas dominantes, las modificaciones al sistema legal interno y las barreras estructurales que restringen la implementación eficaz del DIH.
