Hospital Marco Felipe Afanador. This hospital, operating without the necessary authority, establishes its own rules and procedures for service provision, failing to fully meet the needs of the municipality's population. Therefore, after investigating the functioning of this entity, the importance of creating an IPS is established. Private entities that can supply and resolve these needs to strengthen what is defined as the General Social Security System in Health established in Law 100 of 1993 and its implementing decrees, whose purpose is to comply with the general principles emanating from the 1991 Political Constitution of Colombia. From the above, it is clear that in Colombia, regulations tend to guarantee the provision of health services, coinciding with the importance that the different healthcare providers (IPS) must adopt guarantee systems that allow for social and economic profitability. Healthcare providers (IPS) must have quality and efficiency as basic principles and will have administrative, technical, and financial autonomy. While acknowledging that all agreements or arrangements between healthcare providers (IPS), scientific associations or societies, and healthcare professionals or assistants, or within any of the aforementioned groups, are prohibited if their purpose or effect is to impede, restrict, or distort free competition in the market, or to impede, restrict, or interrupt the provision of healthcare services, it is also undeniable that the performance of healthcare professionals entails a commitment and social responsibility. This implies a willingness to serve individuals and communities regardless of beliefs, race, political affiliation, or any other human condition. It is clear, then, that the current regulations are broad and sufficient for the sector, allowing for free competition and free choice by users in accessing healthcare services.Al iniciar el proyecto de investigación se propone la constitución de una Institución Prestadora de Servicios de Salud en el Municipio de Tocaima - Cundinamarca, dada la coyuntura por las necesidades que atraviesa la población, indicada por las falencias y deficiencias en el sistema que administra la E.S.E. Hospital Marco Felipe Afanador, que sin competencia establece sus normas y procedimientos a seguir en la venta de servicios, no satisfaciendo en su totalidad las necesidades de la población de dicho municipio. Por tanto, después de haber realizado la investigación del funcionamiento de tal entidad se establece la importancia de la creación de una I.P.S. privada, que logre abastecer y resolver dichas necesidades para lograr el fortalecimiento de lo que se determina como tal el Sistema General de Seguridad Social en Salud establecido en la ley 100 de 1993 y sus decretos reglamentarios, donde su finalidad radica en cumplir los principios generales que emana la Constitución Política de Colombia de 1991. De lo anterior, es claro que en Colombia la normatividad tiende a garantizar la prestación de los servicios de salud, coincidiendo con la importancia que las diferentes IPS deben adoptar unos sistemas de garantía que permitan la rentabilidad social y económica. Las IPS deben tener como principios básicos la calidad y la eficiencia, y tendrán autonomía administrativa, técnica y financiera. Sin desconocer que están prohibidos todos los acuerdos o convenios entre IPS, entre asociaciones o sociedades científicas, y de profesionales o auxiliares del sector salud, o al interior de cualquiera de los anteriores, que tengan por objeto o efecto impedir, restringir o falsear el juego de la libre competencia dentro del mercado, o impedir, restringir o interrumpir la prestación de los servicios de salud. En otro sentido no se puede desconocer que el desempeño del Talento Humano en salud lleva consigo un compromiso y una responsabilidad social, que implica la disposición de servicio hacia los individuos y las colectividades sin importar creencias, raza, filiación política u otra condición humana.
