Its relevance lies in the fact that, despite the existence of mechanisms to exercise this type of control, they prove ineffective, either due to lack of awareness or simple practical inoperability. In the context of a Social State governed by the rule of law, where democracy holds significant legal importance, legitimacy derives directly from elections that enable the selection of our administrators and representatives within the State. When these elections yield concerning levels of abstention, the legitimacy of the individual who will govern the municipality for the next four years is directly compromised.Con este trabajo se pretende analizar la ilegitimidad en el ejercicio del cargo de alcalde en el municipio de Buenavista en el departamento del Quindío, toda vez que su representante adolece de legitimidad jurídica para el ejercicio de su mandato y posterior desarrollo del programa que sustentó su elección, emanada del abstencionismo que se presentó en las elecciones del 20071 la relevancia estriba en que pese a existir mecanismos para ejercer este tipo de control, resultan ineficaces, bien sea por desconocimiento o simple inoperancia fáctica.
